Overview
These Terms of Service govern your use of weareforgd.com and any creative, branding, or marketing services provided by Forgd ("we," "us," or "Forgd"). By visiting this site or purchasing services, you agree to these terms.
Forgd is a creative agency based in Fresno, CA. We work with small businesses in the Fresno/Clovis area — restaurants, service companies, retail, and anyone who refuses to blend in.
Short version: Hire us, pay us, get great work. We own it until you pay in full. After that, it's yours. If something goes sideways, we fix it. If you bail mid-project, you lose the deposit. That's the gist.
Service Terms
What we do
Forgd provides branding, social media, and marketing services across three tiers — RAW, FORGED, and TEMPERED. The specific scope of work for each engagement is documented in a Service Agreement issued before work begins.
Timelines
Revision Policy
Revisions are included as part of each tier. A "revision" means changes to existing direction — not a full restart or new concept.
Client Responsibilities
You agree to: provide complete and accurate intake information, respond to feedback requests within 5 business days, and designate one point of contact per project. Delays on your end extend our timeline by an equal duration — we won't penalize you for a slow week, but we will push delivery accordingly.
Cancellation
Either party may cancel the engagement with written notice. If you cancel:
- Before work begins: Full deposit refund, minus a $150 project setup fee.
- After work begins but before first deliverable: Deposit is non-refundable. No additional amount is owed.
- After first deliverable is delivered: Deposit is non-refundable. You owe for any completed work not yet paid for, calculated at our standard rate.
We may cancel the engagement if you fail to provide required intake information for more than 30 days. In that case, we refund the deposit minus work already completed.
Payment & Refunds
Payment Structure
Processing
All payments are processed via Stripe. We accept all major credit and debit cards. By completing a purchase, you agree to Stripe's Terms of Service.
Refund Policy
We stand behind our work. If we deliver something that materially doesn't match the agreed scope, we'll fix it — that's what revisions are for. What we won't refund:
- Deposits after work has started
- Payments for completed deliverables you've approved
- Payments where you've changed direction mid-project
- RAW tier payments (full prepay, no refunds after intake submission)
If you believe we failed to deliver on our agreed scope, email us at forgd@polsia.app. We'll review it. If we agree we fell short, we make it right.
Late Payments
Final deliverables are released only after full payment is received. If final payment is not received within 14 days of completion notice, a late fee of 5% per month applies to the outstanding balance.
Intellectual Property
You own everything we make for you — after full payment is received.
Transfer of Ownership
Upon receipt of full payment for a project, Forgd assigns to you all rights, title, and interest in the final deliverables — including all intellectual property rights. This includes logos, brand identities, copy, templates, and any other creative work produced specifically for your engagement.
Before Full Payment
Until full payment is received, all work product remains the property of Forgd. You may not use, publish, or distribute any deliverable until the project is paid in full.
What We Retain
We retain the right to display completed work in our portfolio, on our website, and in marketing materials, unless you request otherwise in writing. We will not share draft or rejected work without your permission.
Third-Party Assets
Some deliverables may incorporate licensed stock photography, fonts, or icon libraries. We use assets with commercial licenses appropriate for your use. We'll document any third-party licenses that require attribution or have usage restrictions.
Confidentiality
We treat your business information, brand strategy, and project materials as confidential. We won't share your business details, competitive research, or internal materials with third parties. You agree to keep our proprietary processes, methodologies, and unpublished work confidential.
Brand Score™ Tool
What it is
The Brand Score™ tool at /score is a free, automated audit of your business's online presence. It scans publicly available information about your website, social profiles, and Google Business listing and generates a scored report.
Data we collect
To run a Brand Score, you provide your business URL and email address. We use this to:
- Run the automated audit
- Email you the full report
- Follow up about our services (you can opt out at any time)
Email consent
By submitting your email to receive a Brand Score report, you consent to receive that report and follow-up emails from Forgd about our services. We send a maximum of 3 follow-up emails. You can opt out by replying "unsubscribe" or emailing forgd@polsia.app.
Accuracy
Brand Score results are automated and based on publicly available data. Scores are directionally accurate, not auditor-grade assessments. We don't guarantee specific outcomes from acting on Brand Score recommendations.
No obligation
Running a Brand Score is free and creates no purchase obligation.

What we don't do
- We don't sell your data to anyone
- We don't share it with third parties except as necessary to run our service (Stripe for payments, our hosting provider)
- We don't run behavioral advertising based on your data
Cookies
We use session cookies for the client portal (to keep you logged in) and analytics cookies for aggregate site usage tracking. We don't use third-party advertising cookies.
Data retention
Brand Score data is retained for 12 months. Client portal data is retained for the duration of the client relationship plus 24 months. You can request deletion at any time by emailing forgd@polsia.app.
Your rights
You can request a copy of your data, ask us to correct it, or ask us to delete it. Email forgd@polsia.app and we'll respond within 10 business days.
Security
Passwords are hashed using scrypt before storage — we never see them. Payment processing is handled entirely by Stripe — we never touch your card data. Data is stored on Neon PostgreSQL with encrypted connections.
Liability & Warranties
Our commitment
We commit to delivering the scope of work described in your Service Agreement, on time, to the quality standards described. If we fall short on that, we make it right.
What we don't guarantee
We don't guarantee specific business outcomes from our work — sales growth, follower counts, search rankings, or revenue increases. Branding and marketing improve your odds. They don't guarantee results.
Liability cap
To the maximum extent permitted by law, Forgd's total liability for any claim arising out of or related to our services is limited to the amount you paid us for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
Disputes
We'd rather talk it out than litigate. If you have a concern, email us first. If we can't resolve it informally, disputes are governed by California law and handled in Fresno County.
Changes to these terms
We may update these terms from time to time. Changes are effective when posted. If you're an active client, we'll notify you by email of any material changes. Continued use of our services after changes means you accept the updated terms.
